AimedRev (referred to as “we,” “us,” or “our”) values the protection of any personal data you share with us or that we collect when you use our website (the “Site”), located at https://aimedrev.com and our mobile application (the “App”), which can be obtained from the Apple App Store or the Google Play Store. By visiting or using the Site and App (jointly, the “Services”), you agree to the practices described here.

1 Introduction

Welcome to PhysAid (the “App”), offered by AimedRev LLC. (“AimedRev,” “we,” “us,” or “our”), along with our website at https://aimedrev.com (the “Site”). Together, the Site and App form our “Services.” These Terms of Use (“Terms”) apply to all visitors, users, or account holders (“you”). By installing the App, creating an account, or otherwise using the Services, you agree to abide by these Terms. If you do not accept them, please discontinue use immediately.

1. Age Requirement: You must be at least 18 years old to use the Services.
2. Payment/Subscription: Section 7 covers paid subscription details.
3. Dispute Resolution: Section 16 outlines how disputes may be handled by arbitration in the UAE.

2 Privacy Policy

Please see our Privacy Policy for information on how AimedRev collects, uses, and discloses your data. By using our Services, you consent to these practices.

3 No Storage of Protected Health Information

The Services are not designed for storing protected health information (“PHI”). You agree not to upload PHI or any sensitive data that might violate patient privacy laws. AimedRev disclaims liability if you fail to remove PHI before uploading content.

4 Description of Services

AimedRev provides an App and accompanying Site to support medical professionals clinical decisions. Additional tools or features may be introduced periodically.

5 Responsibilities and Representations

(a) Compliance with Law and Conduct

You will not:

1. Violate laws, regulations, or third-party rights.
2. Register if you have been previously banned or suspended.
3. Deceive AimedRev or other users.
4. Use another person’s account or allow others to use yours

(b) Protection of Equipment and Data

You are responsible for:

1. Securing hardware/software (“Equipment”) used to access the Services.
2. Ensuring compliance with all data-privacy laws applicable in the UAE or otherwise.

(c) Professional Judgment

Our Services and any materials therein do not replace your professional judgment. You bear full responsibility for any clinical or medical decisions. AimedRev and its service providers disclaim liability for patient outcomes or harm. AI-generated outputs in the Services may be inaccurate; always rely on your own expertise.

(d) Software Classification

The Services (including any AI/ML features) are clinical decision support software intended for qualified medical professionals. They are not a substitute for independent medical device software. By using these features, you represent you are a health professional and will not depend solely on AI for clinical decisions.

6 License to Use the App

Subject to these Terms, AimedRev grants you a non-exclusive, non-transferable, revocable license to install and use the PhysAid App on compatible devices. If downloaded from Apple’s App Store, you must also comply with Apple’s Usage Rules

7 Payments and Subscriptions

(a) General Payment Terms

We may use external payment processors (e.g., Stripe). AimedRev does not store payment credentials. By submitting payment data, you confirm your right to use it and allow charges to be processed.

(b) Recurring Fees

Some Services require recurring subscription payments. By subscribing, you agree to all fees detailed at sign-up. Charges will recur until canceled according to these Terms.

(c) Cancellation

Cancel your subscription via your account settings on the Site. After cancellation, you can use the paid features until the current billing cycle ends. To avoid next-cycle charges, cancel at least 30 days in advance.

8 User-Submitted Content

(a) Uploading Your Content

You may upload text, images, or audio (“Your Content”), which is hosted on our servers, not just on your device.

(b) Responsibility and Availability

We do not guarantee constant or error-free access to Your Content. You are responsible for the legality and accuracy of what you upload.

(c) Ownership and License

You retain ownership of Your Content. However, you grant AimedRev a worldwide, nonexclusive, royalty-free license to process, display, transmit, and adapt Your Content for providing or improving the Services. This license ends once Your Content is deleted from our systems, aside from aggregated or deidentified data.

(d) Prohibited Material

Do not upload any content that:

1. Infringes on others’ rights.
2. Violates privacy or other laws (including PHI).
3. Is defamatory, hateful, illegal, or otherwise inappropriate.
4. Is primarily commercial without AimedRev’s consent. AimedRev may remove content at its sole discretion.

9 Improper Use of Services

You agree not to:

1. Overload servers, distribute malware, or partake in illegal acts.
2. Scrape or harvest data without permission
3. Provide false information in your user profile.

10 Additional Terms

Certain features may come with separate rules. If you use those features, you agree to adhere to any additional conditions.

11 Termination

(a) By You

You may discontinue using the Services at any time. Account deletion can be requested by contacting support@aimedrev.com or via account settings (if available).

(b) By AimedRev

We may terminate or suspend your account if we determine you have breached these Terms or create legal or reputational risks

(c) Survival of Terms

Sections on warranty disclaimers, liability limits, indemnification, intellectual property, and dispute resolution survive termination.

12 Disclaimers

THE SERVICES ARE PROVIDED “AS IS,” WITH NO EXPRESS OR IMPLIED WARRANTIES. TO THE EXTENT PERMITTED BY UAE LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE CANNOT GUARANTEE UNINTERRUPTED OR ERRORFREE SERVICES.

13 Indemnification

You will indemnify and hold harmless AimedRev and its affiliates from claims, losses, or expenses arising out of:

1. Your use or misuse of the Services, including AI outputs.
2. Any breach of these Terms
3. Professional decisions or omissions causing harm.

This does not apply if the claim results from AimedRev’s gross negligence or willful misconduct.

14 Governing Law and Dispute Resolution

(a) Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles.

(b) Arbitration

Any claim not resolved informally shall be settled by binding arbitration under a recognized arbitration center in the UAE. The arbitration language shall be Arabic or English unless otherwise agreed.

(c) Class Action Waiver

YOU AGREE NOT TO PURSUE OR PARTICIPATE IN CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTIONS.

(d) Venue and Procedure

Arbitration proceedings shall occur in the UAE under local arbitration rules. The arbitrator’s decision is final and binding.

15 Other Provisions

(a) Changes to Terms

AimedRev may modify these Terms. Changes become binding 30 days after notice or immediately upon your acceptance.

(b) Electronic Communications

By using the Services, you consent to receive electronic communications from us.

(c) Severability

If any provision is deemed invalid or unenforceable, the remainder continues in effect.

(d) Assignment

AimedRev may assign or transfer its rights and obligations under these Terms at any time. You may not do so without our consent.

(e) Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AimedRev, superseding prior understandings.
